This Privacy Policy sets out how we collect, use, process, store, share and disclose your personal information on https://live365.com/ (the “Website”), our mobile applications (the “App”), and in providing our internet radio services to broadcasters and listeners (collectively, the “Services”). 1) When We Collect Information

We may collect personal information that you provide when you:

  • Create an account with us,

  • Visit our Website or Apps;

  • Use our Services, including to broadcast internet radio with us or to listen to the broadcaster we host;

  • Sign up for our email newsletter,  or other communications;

  • Contact us.


2) Types Of Personal Information We Collect

The types of information collected by Live365 depends on your role interacting with our services (“User Role”). 

  • If you are connecting to Live365.com or its apps and listening to the audio streams available therein, you are a “Listener” for the purposes of this policy.

  • If you sign-up for a Live365 account for features including favoriting stations, you are a “Subscriber”.

  • If you are using Live365’s platform to host and deliver your own audio streams and programming, you are a “Broadcaster”.

If you register with Live365, as a listener or as a broadcaster, you must provide us with your first + last name, a valid email address, and a password to create your account. You may additionally provide your mailing address and phone number. When creating a station, you must provide us with the station name, website url, logo (optionally), station profile cover art (optionally), genres, description (optional), and links to your social media account (optional).

Subscription and Payment Information

When signing up for a paid package, you will be required to submit your credit card number so our payment processing service provider can process payments related to the Live365 Service.

When communicating with Live365 staff, such as through live chat, our Website, or a support ticket, we collect and log the information you submit to us, including your email address or other copies of your correspondence. If subscribing to a Newsletter, we will collect information from you such as your name and email address.

We may collect information from you relating to your participation in a promotion or survey that we may ask you to voluntarily complete for research purposes.

We obtain information such as your IP address, web browser type, operating system, and resettable device identifiers. This information is used for internal and external aggregated metrics, advertisement delivery, fraud prevention and error logging as it relates to the Live365 Service.

If you access the Services through a mobile device (e.g., a smart phone or tablet), we may be able to identify the general location of your mobile device, your mobile device’s brand, model, operating system, resolution, screen size, system version, mobile network information, and your mobile device’s advertising ID.

We infer your location by utilizing your IP address to determine a general geographic region. This information is used for personalized audio or display advertising and compliance with regulatory laws as it relates to music copyrights.

When you browse our Site, our systems automatically collect information such as your web request, Internet Protocol (“IP”) address, browser type, browser language, domain names, referring and exit pages and URLs, platform type, pages viewed and the order of these page views, the amount of time spent on particular pages, and the date and time of your request.

When you interact with our accounts on our community forums or through our brand or community forums on a social media platform, we may collect certain information that you or the platform make available to us such as Website metadata analytics (above), your social media account ID, your social media ‘likes’, click-throughs to our Website, or custom interactions.

We may also make inferences about you such as your interests that we believe are relevant to you based on the information we have collected. 


3) How We Use Your Information

We use the personal information we collect for the following purposes:

  • To operate and improve our Services. 

  • For internal and Service-related purposes, including for accumulating and reporting aggregate, statistical information in connection with the Website, Apps, and listener or broadcaster activity, including determining which features and services listeners and broadcasters like best to help us operate, enhance, and improve our Services.

  • To process payments securely.

  • For customer support and other Service-related communications, regarding the administration of any features or functions of the Services, and notifying you about changes to our Services, policies, terms, or any products or services we offer or provide, as well as providing you with notices about your account and responding to your questions or other requests.

  • To send you marketing and promotional emails, including via our newsletter, that may be of interest to you based on the features or services that you already use or the offerings that you have already subscribed to or inquired about, unless you have opted not to receive such information.

  • For marketing and advertising, On third party sites as well as on the Live365 Services, such as delivering audio advertisements within Live365 streams you connect to, or displaying banner ads on the Live365 Website

  • For other business and legal purposes, such as to detect and prevent fraud, to collect amounts owing to us, and to maintain business records.

  • With your consent.


4) How We Disclose Your Personal Information

We may disclose your information with your consent. We may also disclose your information with our corporate affiliates, as well as vendors or service providers who:

  • Help us communicate with you. 

  • Manage and optimize our Website, Apps, and Services.

  • Help us provide our chat support services. This may include disclosure of the communications with our service provider, Freshdesk. The contents of the communications will not be used for any purpose other than to support us, but are also subject to Freshdesk’s applicable privacy policy which can be found here: https://www.freshworks.com/privacy/

  • Provide marketing and advertising services. For example, we may disclose personal data with our advertising partners who help us deliver audio advertisements within Live365 streams you connect to, or displaying banner ads on the Live365 Website. In addition, we may disclose personal data to third parties via cookies and other  similar tracking technologies for the purpose of placing targeted ads on third party sites(see ‘Use Of Cookies And Tracking Technologies’ for more information on your choices with these services).

In addition, we may disclose your personal information:

  • As required by law and to protect our lawful interests. For example, we may disclose your personal information in order to: 

    • Protect the legal rights of our company, our employees, our agents, and our affiliates.

    • Protect the safety and security of our customers.

    • Detect and protect against fraud.

    • Comply with law or legal process.

  • As part of a business transition. We may also disclose your personal information with prospective purchasers exclusively to evaluate the proposed transaction. We may also disclose your personal information with another company that buys the assets or stock in us. That company may use and disclose personal information for purposes similar to those described in this Privacy Policy.

We may disclose de-identified, aggregate, or anonymous information for any purpose. This means that the information we disclose does not identify specific individuals or is combined with other data to protect your privacy.

You have the right to exercise the following choices with our use of your personal information:

  • Delete the personal information we maintain about you. 

  • Correct inaccurate personal information we maintain about you

  • Opt out of certain uses of your personal information, notably:

  • Email marketing. You can unsubscribe to our email list by clicking the unsubscribe link at the bottom of marketing emails.

  • Targeted advertising. Please refer to the ‘Use of Cookies and Tracking Technologies’ section below to learn how to opt out of tailored ads.

6) Cookies and Similar Technologies

Like many companies, we use cookies and similar technologies (such as clear gifs, web beacons, tags, and similar technologies) to collect information about your browsing activities, your interactions with websites and our Services, and to serve tailored ads and for the purposes described in this Privacy Policy. There are a number of ways to opt out of having your online activity and device data collected through these services, which we summarize below:

  • Opting out of cookie use in our Cookie Preferences. You can opt out of cookies via our cookie preferences center: https://live365.com/legal/cookies

  • Blocking Cookies In Your Browser. Most browsers let you remove or reject cookies, including cookies used for interest-based advertising. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings.   • Advertising Industry Opt-Out Tools. You can also use these opt-out options to limit use of your information for interest-based advertising online or in apps by visiting http://optout.aboutads.info for U.S. residents, https://www.youronlinechoices.eu/ for EU/UK residents, and www.youradchoices.ca for Canadian residents.

Please note that because these opt-out mechanisms are specific to the device or browser on which they are exercised, you will need to opt out on every browser and device that you use. 

Please note that even if you opt out using the mechanisms above, you may still receive advertisements when using the Live365 Service.


7) Mobile Privacy

In addition to the above, in providing our services, we may collect or receive identifiers for mobile devices. 

You can adjust your advertising preferences multiple ways in iOS: 

  • Go to Settings > Privacy & Security > Apple Advertising and toggle the switch for Personalized Ads. This action will prevent Apple from displaying personalized ads, though it will not reduce the volume of ads you see. 

  • Go to Settings > Privacy & Security > Tracking. Here, you can prevent apps from tracking your activity across other apps and websites and reduce the risk of seeing personalized ads.

  • Go to Settings > Privacy & Security > Location Services and toggle off the switch for Location Services. This will turn off any personalized geo-targeted ads (and otherwise prevent apps from tracking your location).

To adjust your advertising preferences in Android, visit: 

  • Go to Settings > Google > All Services > Ads > Ad Topics and toggle the switch for personalized ads.

  • Go to Settings > Google > All Services > Ads > App-Suggested Ads and toggle the switch for personalized ads on apps recommended by other apps.

  • Go to Settings > Google > All Services > Ads > Reset/Delete Advertising ID.

Additionally, you can opt out using industry tools. For example, visit https://youradchoices.com/appchoices to download the AppChoices Tool to control interest-based advertising on apps on your mobile device. 


8) Security

We protect information we collect about you by maintaining physical, electronic and procedural safeguards designed to prevent unauthorized access to data retained in our servers, however, due to the inherent open nature of the Internet, we cannot ensure or warrant the security of any information provided online. We take reasonable precautions to protect your information both online and offline. The servers on which we store data are kept in a secure environment.


9) Retention

We will retain your information for as long as your account or inquiry is active or as needed to provide you with the website or any requested services, and for a reasonable time thereafter in accordance with our standard procedures or as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Even if we delete some or all of your personal information, we may continue to retain and use aggregate or anonymous data previously collected and/or anonymize or aggregate your Personal Information. Please note that we will not be liable for disclosures of your data due to errors or unauthorized acts of third parties.


10) California and U.S. State-Specific Disclosure

California and other U.S. states have enacted comprehensive privacy laws. If you are a resident of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have certain privacy rights detailed herein.

In addition to the rights granted above, if you are a resident of the above states, you may have the right to:

  • Opt out of the ‘sale’ or ‘share’ of your personal information for targeted advertising. We do not ‘sell’ or ‘share’ your personal information for monetary benefit, but we do engage in certain disclosures of personal data for advertising and marketing related purposes that may be considered a ‘sale’ or ‘share’ under these privacy laws. You may opt out of such cookies as detailed in ‘Use Of Cookies And Tracking Technologies’ section (above). 

  • Sensitive personal information. We do not collect sensitive personal information as regulated by these state privacy laws.

Appeal:

If we deny your privacy request, you may appeal that decision by emailing us at privacy@live365.com. If, after we have processed your appeal, you are still unsatisfied with our response, you have the right to file a complaint with your state attorney general.

Controller/Business Designation:

In providing our Services to our Broadcasters, we operate as a Processor (and a Service Provider under CCPA).

In providing our Website and Apps, and in processing Listener and Subscriber data, we operate as a Controller (and a Business under CCPA).


11) UK/EEA Residents Notice

Residents of the (“UK”) and European Economic Area (“EEA”) are provided certain privacy rights under the UK and EU General Data Protection Regulations (“GDPR”).

In providing our Services to our Broadcasters, we operate as a Processor.

In providing our Website and Apps, and in processing Listener and Subscriber data, we operate as a Controller.

Cross-Border Data Transfers: 

All data is stored in the United States. As such, if you are a resident of the EEA, UK, or Switzerland, we may transfer to, and store the data we collect about you, in countries other than the country in which the data was originally collected, including the United States, which may not have equivalent data protection laws as the country in which you provided the data. When we transfer your data to other countries, we will protect the data as described in this Privacy Policy and applicable supplemental product privacy policy and comply with applicable legal requirements providing adequate protection for the transfer of data to countries outside the EEA, UK, and Switzerland. We rely on Standard Contractual Clauses (“SCCs”) for the transfer of personal data to countries that have not received an applicable adequacy decision, as well as the UK’s ‘International Data Transfer Addendum’ to the SCCs.

12) Children’s Privacy

We do not intentionally collect any personal information from children under the age of 13 (or 16 in California). If you are under the age of 13 (or 16 in California), please ask a parent or guardian for help in using our website or purchasing any products. If you believe we have obtained personal information associated with children under the age of 13 (or 16 in California), please contact us at privacy@live365.com and we will delete it.

Our Services may contain links to other websites or services. We do not exercise control over the information you provide, or is collected by these third party websites. We encourage you to read the privacy policies or statements of the other websites you visit.

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated Privacy Policy on this page with a “Last Updated” effective date of the revisions. We encourage you to look for updates and changes to this Privacy Policy by checking this page when you access our Services.
